The NSW Government has announced a transitional arrangement for the implementation of the new BASIX requirements in NSW. The changes will ensure that clients that have signed a building contract on or before the 30th September 2023 will be able to achieve compliance with the current BASIX requirements, in lieu of the new 7-Star requirements. The details of the changes are as follows:
- Projects with buildings contracts signed on or before 30th September 2023 will be able to use the existing standards.
- The projects must be for a detached dwelling or dual occupancy.
- Have a contract price of no more than $2million (build price).
- The contract must clearly specify the design and specifications of the home to which the contract applies.
- Eligible applicants must generate a BASIX certificate by 30 June 2024, and lodge a CC/CDC application before the BASIX certificate expires (3 months).
To ensure your project is eligible for the transitional arrangements, an application will need to be submitted to the Department of Planning and Environment to use the existing BASIX standards.
Building Contracts that are signed on or after 1st October 2023 will need to comply with the new BASIX requirements.
What does the recent announcement mean for me?
If you have already signed a building contract with your builder, and the builder obtains a Basix Certificate for your new home before 30th June 2024, then you will be eligible for the transitional arrangement (subject to the conditions mentioned above).
